  • money claim form

Hi. I would like to ask if anyone can help me with my problem. My ex-husband made a money claim asking for £ 30,000 in total from me. I need to mention that we separated in 2015 and divorced in 2018. £ 20,000 child maintenance money as he lied in his statement saying that I had given the wrong information to CMS saying that our childcare was not 50/50 shared. It was not as my son spent just 2x nights/ month between 2105-2021 and from 2021 till present we have a child arrangement order where he spends 8x nights/ month for 6 months and 6x nights/ months for the other 6 months. The rest of the money from his claim of £ 10,000 he said is for it because of my refusal to sign travel documents and he had solicitors fees to cover for writing an official letter to me and booking holidays and paying in full the amount without having my consent or my son's passport in his possession. He said he asked for a refund but was declined by the holiday companies, therefore he suffered a major financial loss.
I need to mention he attached as proof of documents 2x emails as photos without the sender's details, a credit score report for some loans taken during our marriage which I don't know about it and a few papers from child maintenance service.
Can anyone advise me on what can I do to discover him, I presume some of the papers attached by him are fake as he is an expert of the Photoshop app and I know from his ex-partner that he used to make up fake documents. How should I write my defence and how can I ask the Court to investigate the credibility of his claim? I already filled in an acknowledgement of service as I need more time for my defence. The papers arrived before my booked holiday so I have just a few days to prepare my defence.

I note that you filed an acknowledgement of service of the claim form. Presumably, you did so within 14 days of your receipt of the claim form.

Post up a redacted copy of the claim form that you received from the court.

Also, please be aware that documentary evidence is put before the court by means of a witness statement containing a statement of truth in proper form per CPR pd 22 and NOT when issuing the claim.

It would be helpful if you paragraph your postings on here.
