OK so. I'll put it as simply as I can.
Gran and grandad bought a house in their 20's when they were married and at some point before I was born they got divorced but continued to share the house. And what I presume is they agreed 50/50 on the house?
Gran is 99 and isn't in the best health. She has already seen a lawyer with my aunty to put down her wishes. So far as we know at the moment in regards to the house she has said that she wants her half of the house put into trust so that my uncle (who lives with her) has somewhere to stay and doesn't want her half to be sold.
What complicates this (I'm guessing) is grandads half. He has said for the last 30 od years that when he goes he's leaving his half of the house to my mother. He hasn't had a lsolicitor witness him signing a will (don't know if that is needed because he has wrote that done in a letter that he keeps in his draw.)
What position would mother be in if 50% of the house is in trust and she wants to sell her half?
Unfortunately my uncle has made poor decisions all his life and after Gran goes won't have enough income to be able to keep up with maintenance or bills. One of the reasons I'm asking is to try and make sure mother isn't left in a position where she has to pay for the upkeep of a house that she can't sell while someone is living there rent free and letting it go to rot.
Can she force him to sell his half?
Could she charge him rent on the 50% of the house he doesn't own?
I hope this makes sense. Mothers a bit worried about it so I thought best to get some information while grandad is still with us so she can either ask him to leave it to someone else or do something that doesn't leave mother in a sticky situation.
