  • Can I negotiate a shorter notice period for end of tenancy agreement

    Background:
    • I have lived in this rental property (2 bed flat in a block of 6) for 4 years 3 months
    • My tenancy had just been renewed on 1 April 2023, with a 6-month break clause at 30 September
    • There are 2 separate agents who deal with the property; agent A handles marketing & lettings, agent B deals with tenancy agreements & rent
    On 8 July agent A called & left a voicemail, telling me that the landlord was selling all 6 flats. Contractually agent B would have to give me notice in writing on or after 1 August, but I didn't want to wait and found a new flat to move into on 21 August.

    Question: I want to avoid paying rent on 2 flats for 6 weeks, so can I claim that I was effectively given notice of end of tenancy by agent A?

    PS: According to their web site, agent A is a trading name of agent B

      I can't see how "telling me that the landlord was selling all 6 flats" could be considered as an indication your tenancy will be terminated. The landlord selling a property doesn't automatically terminate the tenancy. It just means you continue as a tenant with a new landlord unless and until notice is given.

      There's nothing to stop you using it as part of your negotiation for early termination of course.

        Two of the 6 flats are already being advertised for sale as separate units - the apartment block isn't been sold as a tenanted buiding

          Doesn't make any difference how it being sold, it still doesn't terminate your tenancy unless and until valid notice is given.
