  • MCOL Small claim transferred to local court - how to inform of settlememt?

    Good morning. I brought an MCOL small claim against a business. They defended and the case was transferred to the small claims track at my local court. The defendant then contacted me and offered to settle. They have now paid me (slightly less than the full claimed amount, but accepted). How do I best inform the court?

    I have tried searching and started to get somewhat confused after reading about consent orders and the costs of those, Tomlin orders (which it sounds like the defendant would file) etc.

    Given that I have received payment and would not wish to reopen the case, can I file a N279 form to discontinue? It sounds like I run the risk of becoming liable for the defendant’s costs if I do this.

    Am I overthinking this? Should I just write a letter to the court?

    Yes. Write a letter.
