    Hello.

    The 'First Steps to take on receipt of a County Court Claim' advised me to make this post with the following information

    Received a claim?: Yes

    Issue Date: 26 June 2023

    Have you Acknowledged the Claim?: No

    Total Amount Claimed : £1000

    Claimant’s Name: Cabot Financial (UK) Limited

    Solicitors Firm: Mortimer Clarke Solicitors

    Original Creditor: New Day Limited RE Fluid

    Original Debt: Credit Card

    Particulars of Claim: "By an agreement between New Day Ltd RE Fluid & the Defendant on or around 17/06/2019 ('the Agreement) New Day Ltd RE Fluid agreed to issue the Defendant with a credit card. The Defendant failed to make the minimum payments due. The Agreement was terminated following the service of a default notice. The agreement was assigned to the named Claimant. Cabot Credit Management Group Limited, acting as servicing agent of the named Claimant through its Appointed Representative (Cabot Financial (Europe) Limited) has arranged for these proceedings to be issued in the name of the Claimant. THE NAMED CLAIMANT THEREFORE CLAIMS 1. £XXXX.XX 2. Costs"

    Is the debt Statute Barred (have you had any contact with the creditor or claimant over the last 6 years?): The debt is not statute barred however the last communication I received regarding the debt was the default notice some months ago.

    List any letters you have sent (eg: CCA/ CPR ): Nothing yet as I have just received the Claim Form today.

    Any Other Information or Background Details: Not really sure what to put here.

    This is my first time dealing with anything like this and initially it caused a great deal of anxiety before I found this website. The information on the 'First Steps to take on receipt of a County Court Claim' put me at ease while at the same time making it clear that this situation is not to be taken lightly, I am grateful for that.

    I plan to acknowledge and dispute the claim then request a copy of the Credit Agreement. Are these the correct steps for me to take and is there anything else I should do or be aware of?
