  • Insurance settlement claim

    Whilst travelling on the roads in Kent on 18/08/2022, I was stopped at a junction on my motorcycle BMW LT 1100 when I was struck by a car driven by an elderly lady which resulted in damaging my motorcycle. I am still in consultation with the driver’s insurance company. They have recently made an offer in respect of a total loss to my motorcycle via an email which I have accepted. My question is, as I have accepted the proposed total loss value from the insurance company, are they legally bound to honour it and thus pay the agreed amount?

    They made the offer. You accepted,I cannot see any problem.

      I'd say yes, unless some new and relevant information came to light after the offer but before it was paid. Or there was some error like putting too many zeros in the amount so that the offer was obviously a typographical mistake, like offering you £10,000,000 for your bike.

        If they do not pay, then you may sue for the full amount of your loss.
