My aunt lost her husband last year and probate has been granted. His will named his son and daughter as beneficiaries but with a life interest for my aunt so that she can live in the property until such time as she passes on. The son and daughter have engaged a solicitor who have told my aunt that she needs to protect their interests by transferring the property into theirs and my aunt's names. They also want a Declaration of Trust drawing up and signing by my aunt. They expect her to pay 50% of the costs of both. She has already agreed to pay each of them half of their inheritance from her husband. Is she also legally obliged to change the house into all of their names and pay for a Declaration of Trust?
I'm afraid that her son and daughter have not shown themselves in a very good light and she feels that she will eventually lose control over what she can and can't do with the house. She has become very anxious and depressed but won't be left with a lot of money once she pays out half of their inheritance so is reluctant to pay for a solicitor. She is in her 80's and in a bit of a state so any advice would be much appreciated, thank you.
