  • Child custody-but no order

    Hello, I was divorced in Texas about two years ago. My divorce was uncontested and I was given "exclusive right to designate primary residence" of my four children. My ex-wife and I both lived in Texas at the time. At the time of my divorce it was understood that I have physical custody of my kids with a generic parenting plan. About 3 months later my ex-wife moved to Michigan. About 6 months after that around Christmas time, I was told that I could possibly be deployed within 96 hours. So I made the hard decision to move my 4 children to Michigan as a precaution. We didn't end up deploying for almost a year. On top of all this I found out that I will be leaving the deployment early and then returning to complete another 9 months overseas (ending in July of 2024). I retire from the military in July of 2025.

    The change in custody was done "under the table" with only a few emails and text messages confirming that I would pay a fixed amount of Child support.

    My question is, how do I make everything "legal" and what is the feasibility of getting custody of my kids when I am out of the military?

    Things that are on my mind are: jurisdiction-did it automatically transfer to michigan? do i need to petition the court in Texas to transfer jurisdiction? Will Michigan change the "under the table" agreement if jurisdiction has been changed.
