I've been having my bathroom done, a month or so ago my downstairs neighbour complained of water leaking through the ceiling. It wasn't bad at the time, and being evening time I messaged the project manager just to tell him but said it didn't appear urgent. I had no response, then about 11pm it was much worse. My neighbour contacted a plumber she knows who came out and checked pipes at mine, he said it was caused by the work being carried out.
The next day the company refused to accept liability on the grounds that I didn't contact them, the office was showed as shut and as the project manager didn't get back to me. Turns out they have a 24 hour service which was given to me on a welcome pack, which I didn't notice. I was half asleep when my neighbour knocked my door and said she would get a plumber she knows out, I didn't think I just reacted to the situation at hand. There was nothing given to me in T&Cs to state I should contact them in an emergency or they would not be liable.
Now I am not one to back down, and since now they said they won't accept liability as it wasn't on an area of pipe they had been working on. The plumber has written down his findings of it was 100 percent caused by work being carried out as well as video evidence .
The work has been substandard in general I have had to call them back numerous times. Its finally coming to an end and I have this bill, as well as neighbours roof which according to the plumber who I asked to contact company ages ago, they said they would pay but since have said they won't be. I have raised a complaint with wickes and they still won't back down.
I think I will take the plumbing bill off the invoice, what's grounds do I have to do that?
