  • CIS (Construction Industry Scheme) : Agencies docking pay?

    I work as a carpenter for a company Via an agency, I have a company Van. The agency has sent me an email on the 12.04.23 with two PCN charges from back in February amounting to £160 which there taking out of my weekly pay on Friday 14.04.23.

    Because I work a week in hand there actually removing money from last weeks pay and only given less then two days notice of any changes to my pay.

    Is this legal? as I assumed that any action to my pay would affect the following week as I work a week in hand?

      I have a contract with the company I work for but there not the issue the PCN pass through three separate companies.

      the company I work for.
      Fleet for the Van.
      And the agency the company I work for pay to hire me.

      The company I work for will allow almost any agreement to pay back the PCN
      Fleet have no objection.

      Fleet Receives the PCN then notifies the company I work for then the company notifies the agency.

      its the agency that has given me less then 2 days notice and is effectively sanctioning money from my last weeks pay or just proccing it and telling me last minute.

      anybody have any decent advice on this?

        I believe what dslippy was referring to by looking at your contract is what, if anything is stated about deduction from wages, it may not specifically mention deductions for PCNs but it may talk about money owed to the company. If this is in our contract then the company can make these deductions although I agree that two days notice is not ideal.
