  • Final Charging Order

Hi everyone a Newby here can you help me.

I live with my partner who has 2 charging orders on our property.

They are both in excess of 8 years old.

I want to sort them out PDQ as they are preventing growing our business.

Has anyone any experience in making a lower offer to settle

    Can you help

Whilst I can't speak directly from experience with regards to full and final settlements for a charging order, I do have recent experience for two debts, one of which had proceedings issued via the county court. One creditor (Arrow Global) I owed a shade under £5k to. I initially offered them 25% which they rejected. They came back with a counter offer of 1p over 50% which I accepted. The other, which had a claim issued for £8900 plus interest and costs (an eye watering £11238.83) was settled eventually for £7200. This was all done without the need to fill in the usual income/expenditure forms. I'm going to assume the same 'rules' apply that anything over 75% is likely to be accepted. My advice would be call them and discuss. The rep's at these companies take a load of grief every day and when someone is actually reasonable they do what they can to help
