  • Raising a Time Order (Scotland)

    Hi,

    I joined the forum as I have read a lot of solutions on here and hoping I can get some advice for myself. I have had a default notice and termination notice on my HP car finance agreement and asked the finance company for a time order however they have not started the process and are just trying to repossess the car via an agent. I have informed the agent that I requested the time order and I also have not received any court orders, as I live in Scotland are they allowed to do this? I want to raise my own Time Order to get the process started and be done with the stress of it all but I'm having some trouble with the steps involved. I have the form filled out but wasn't sure the next steps. Do I post this to my local Court? Once I have sent it to them what steps are next and will this put a stop to any further collection activity while it is being processed through the courts?

    Sorry for all the questions just a lot of information I am reading through and want to make sure I'm doing everything correctly.
