  • Letter of Claim/Email

Hi I would be grateful for any help I can get in dealing with DCB Legal. I received a Letter of Claim 16 January 2023 on behalf of their client UKPC Limited. The PCN dates back to 2019 which I have no clue about. It was supposedly issued for failing to display a Blue Badge whilst parked in a BB bay. I completed an online defence and enclosed a copy of the relevant BB. However today I received an email from DCB Legal. Please see below

"We write in response to your email dated 21st January 2023.

We note you are disputing the Parking Charge Notice (PCN) as you state you are a blue badge holder.

Please note, although you may hold a blue disabled badge this was not displayed on the day of the contravention (see attached images). The signage states a valid disabled badge must be clearly displayed at all times, therefore the PCN was issued correctly.

As the PCN was affixed to the vehicle on the day, you were afford the opportunity to appeal within the 28 day period. Given that the case has been escalated to this firm for recovery action, the 28 day period has elapsed and the right to appeal has now been lost.

In accordance with the British Parking Association (BPA) Code of Practice, where the Parking Charge Notice (PCN) becomes overdue and before Court proceedings have commenced, a reasonable sum may be added for the debt recovery fees. The correct recovery fees have been added and will not be removed.

You now have 30 days from the date of this letter to pay the outstanding balance of £160.00. Failure to do so will result in a claim being issued against you without further notice.

    Kind Regards"

I never received the original PCN and it was certainly not attached to my car. There were no pictures attached to their email nor do I ever fail to display my BB its always on my dash.

Can anyone advise what my options are as I believe DCB Legal are trying to pull a scam on me.

    Thanks in advance
