  • EON Next - County Court Claim

    Hi,

    I have today received a court claim from EON Nexy for a utility bill dated 2018. I have tried to access your 'First Steps' information but the links are broken and I am receiving a 404 error message.

    Can you please provide the correct link on this thread.

          I am currently unemployed in receipt of Universal Credit so can not afford this bill let alone any others atthe moment as I receive less than £300 per month. I vagauely recall this bill? I have statements from EDF and NPOWER and I am currently with Octopus Energy. Nothing from EON Next. I recall at the time I was receiving letters from utility providers statng they had taken over my account as my current provider had gone into liquidation so I believe this is how I ended up with EON NEXT as a supplier.

          Where they claim the supply period as 'LIVE' I dispute that as I do not have a contract with EON currently. I recall disputing this debt as in the interin EON had been sending me letters weekly regarding a debt, each time adding £23.50 adim chages too the debt which at the time was over £1000. They instructed their field debt solutions team to visit my home demanding payment on the doorstep, which due to the aggressive nature of the visit I paid the entire bill in full and them immediately switched provider. A week or so later I received another bill froom EON including further charges demainging what was at the time £154 which I did not respond to.

          CST Law sent a letter dated 24th Nov 2022, which I did not receive until 27th Dec 2022. I assume they either posted late or I received late due to postal strikes, leaving me 3 days to respond. Before I could respond I received the court papers which were issued on 5th January. In between that time I received correspondance from Past Due Credit dated 09/05/2022 for £154.80 and 26/10/2022 for £175.70. I have no clue why this bill keeps going up and up.

          I am still searching through paperwork and emails to see if I can find anything else and will update this thread again soon.

          Any assistance or advice regarding this would be greatly appreciated.

              I have found all the relevant documantation on email, thank god.

              So, EON Next took over my power supply from NPOWER around the 10th January 2021. I was in and out of work as I was contracting and my bill went up to £2108.75.


              On the 25th March EON sent their field debt solution team to my home to collect the full balance at the time which was £1730.70 and added an extra £55 to my account for the visit, I was not at home and was not made aware of the visit until I returned home to a letter they had posted.

              On 15th March I put in an application to switch supplier which was rejected.

              On 3rd May I made one nominal payment of £10 as I was in receipt of benefits and could not afford to pay any more.

              I contacted EON to advise them I was struggling to pay my bill as I was in receipt of benefits, I was in the process of going to interviews and anticipated I would be back in work relatively soon at which point I would make arrangements to bring my account up to date. On the 25th June I received email contact back from EON advising I should contact them to set up a payment plan and to contact Step Change, but they also advised that if they did not hear back from me by June 6th they would apply to the courts for a warrant of entry, so they gave me very little time to contact Step Change and arrange for them to act on my behalf.

              I returned to work shortly after and on 11th July I paid £500 on to my account reducing the bill to £1668.75.

              6 days later the field debt team turned up at my house again with a warrant to gain access to my house to change my meter to a pre-payment meter and collect the outstanding balance in full. The field agent claimed that he had no record of me paying £500 6 days earlier and he forced his way into my home demading the full balance. I was forced to pay the balance in full, even though I had onnly just returned to work and I had not paid my rent, bought food for the month or paid any other bills. The payment of £1668.75 left me destitute, and again they added a charge to my account for the visit.

              I'd advised EON that I suffered from long term depression and that my menatl health was an issue, which affected my work status, which was why I was in and out of work, they ignored this. Subsequently as I made the paoyment to EON and could not pay my rent, the council then issued a posession order on me, they alos added court costs.

              Despite keeping in contact with EON, there are several occassions where they have ignored my requests for assistancce or made it impossible for me to seek assistance with their unreasonable timelines, and each time they threatened action against me thay added additional charges to their correspondance.

              I put in an application to switch supplier the same day but shortly after paying the £1668.75 EON sent another bill for £154.80 which is what the County Court Claim is for. I disputed this amount with EON stating that had already received this and more by way of the 'unlawful' charges they added to my account. They did not respond to my complaint.

              So here we are.

                You need to Acknowledge Service within the first 14 days, that can be done online, that gives you 14 + 14 days to file your Defence with the Court, so that 28 days plus 5 for postage.

                a) Send a 31.14 request to CST LAW, they have 7 days to respond after receipt of letter (keep an eye on that). Make sure you get Proof of Postage.

                b) Send a SAR to Eon Next, they have 30 days to provide all the data on the accounts, make sure you get Proof of Postage.

                c) Write a list of where you believe EON has acted 'unfairly' towards you, i.e. unemployed, illness, not keeping to time lines, etc. If you've been treated 'unfairly' write a Formal Letter of Complaint, explain where they have treated you 'unfairly', follow their complaints procedure. They've started legal action, so might be reluctant in dealing with it.

                Work out the date your defence has to be lodged with the Court and the creditors solicitor, note it in the diary, do not forget. Update the thread a week before you have to file your Defence.

                    a) Send a 31.14 request to CST LAW, they have 7 days to respond after receipt of letter (keep an eye on that). Make sure you get Proof of Postage.

                      Also, confused about this. As EON have 30 days to prive the info requested under SAR that takes me outside of the 14/ 28 days I have to dispute my claim. Can I request this info be sent to me sooner?

                      b) Send a SAR to Eon Next, they have 30 days to provide all the data on the accounts, make sure you get Proof of Postage.

                          In reality you have 33 days, but it's best to work towards 28 days, (14 + 14 + 5), so you should get it back in time.

                          The sooner you send it, the sooner you will get it back. Also it's something you can put in your Defence, that it has been requested.
