    Can anyone advise re the legalities of using a company name and or associated name with similar names on vehicles, shop frontages, uniforms etc, without company trade marks, copyrights and or legally existing company names on companies house in some cases

    I am not using the actual company name here, the name being used is purely for representation and is not the name of the company involved and has no association with any problems with the actual company I am referring to) but for reference this name is being used to represent my dilemma.

    Please note I am taking civil action for numerous building issues including failures to comply with building regs and or structural engineering drawings during any extension, plus taking cash payments that have not been declared and breaching my consumer rights.

    The default alias being used is "Quality" (for reference only)

    The business is using names like;

    "Quality' no company actually exists - used on signs vehicles etc

    "Quality Projects" - no company actually exists, used on payment requests and referenced in voice mails, uniforms, vehicles etc

    "Quality Projects Ltd" - being dissolved, but not used on any documentation I have received

    "Quality Construction (Wimbledon) Ltd" - subsequently being used on invoices but never previously referenced

    "Quality Developments (Wimbledon) Ltd" - newly set up

    "Quality Group Ltd" - newly set up despite this already being owned by someone else

    Website domains;

    "QualityGroupLtd.co.uk"

    "QualityProjectsLtd" still being used despite being in liquidation

    plus many other associated businesses either active or dissolved or being dissolved owing hundreds of thousands of pounds to clients and the HMRC.

    Staff uniforms use 'Quality Projects' on the back

    Cars, website and shops have 'Quality', est 1940 (despite not being around in the 1940's), on the side.

    Website sites imply they have been established for over 25 years, yet none of their associated businesses have been established for more than 10 years.

    Invoices raised using a company name I have previously never heard of and addressed to an unknown recipient despite apparently posting to me all on the same date via email over a year and a half after the work was apparently done.

    Builder failed to provide building regs despite stating an email that he would

    Failed to provide gas safety certs despite saying he would

    Failed to provide electrical safety certs despite saying he would

    Failed to provide insulation certs despite saying he would

    Failed to provide receipts

    Held onto my door keys when requested to be returned

    Failed to provide invoices when requested (over a year and half late as mentioned)

    Failed to install an extractor fan in a down stairs toilet (required by building regs)

    Failed to install structural steels according to engineering drawings

    Failed to install structural steels that were straight

    Failed to follow building plans re wall heights

    Etc Etc Etc

    The lsut goes on and on and on, but my main concern is re actual usage of company names and how to go after the builder personally (contract was implied), as he seems to be trying to hide behind a ltd company status although there is nothing re any paper work that supports this position. Even accounts were paid to an un limited company.

    Any help much appreciated

    Quite a number of laws may be engaged, depending on the circumstances (about which your post is unclear). One possibility that springs to mind is the "phoenix companies" legislation in sections 216 and 217 Insolvency Act 1986.

      Be careful not to engage in a game of spotting the weakest link.

            Information about the circumstances would help. Who are you suing, and how do all the other names come ito the story?
