  • Employer's duty of care to employees

    My friend is an experienced Nurse and a Care Home Manager: two months ago she was appointed a Care Home Manager with a company with several Care Homes. During the interview she was promised supports, particularly over cover for absent staff and an "on call" duty rota for the weekends, None of this has transpired and my friend has been lumbered with covering absent nurses, even covering for the Chef on two occasion, working 108 hrs one week.

    Last week, she was stressed out: the Regional Manager told her to go home : she has self certified her absence and has her Doctor"s support to follow.

    She's a caring woman and has the residents' welfare first and foremost: given her previous management responsibility, she knows good practice and when things are not safe
    handling all medication. All these concerns have been forwarded to HQ to no avail and, given, she is the Registered Manager, this has been an extra strain on top of the cover etc.

    The company have exploited her goodwill to the point of abuse: she has resigned but has to give 12 weeks notice and de-register as Home Manager.

    Can anyone please advise if there some legal procedure to recover employee compensation for such a negligent duty of care, when an employee suffers undue stress, caused by management failing to recognise Home problems and leaving the Manager to 'sink or swim" ?

    Hi crowncourt there is nothing under employment law that I can think of that your friend would be able to bring a claim under since she has now resigned and has less than 2 years' service.
