  • FTR state I owe a debt.

    Hi, I need some advice regarding a debt, the company is fast track reclaim who state I owe them £500.
    I strongly believe I don’t, I’ve never received any PPI, but did ask them back in 2019 to do a free PPI check on my behalf, but nothing ever materialised from it and I’ve never thought about it.
    They’ve threatened to start legal proceedings if I don’t respond within 7 days which is this Friday.
    How do i/should I respond to stop any action and find out how they believe I owe this amount?

    I have emails they’ve sent me etc to show if needed.

    The emails are also from Joseph James Law and are quite threatening/intimidating.

    FTR and a few other claims management companies ran these 'free PPI checks' via ads on Facebook that acted as contract traps. The 'free PPI check' websites were often run by a lead generator called Fountain Finances if that rings any bells. See example below.

    There's been a lot of controversy over them as they have generated a large number of complaints, mainly that people felt that they were duped into entering contractual agreements for claims management services and digital signatures were applied to documents without their knowledge or informed consent.

    Unfortunately most complaints that land up with the Financial Ombudsman are rejected - in my view unjustly - on the basis that the customer benefitted from the successful PPI claim.

    However if you never received a PPI refund and they are asking you for commission for receiving one then you have a good case.

    There may be other reasons why they have invoiced you, for example if you received a final response to a PPI claim from a bank (regardless of whether the claim was successful) and didn't provide it to FTR, as the terms in their contracts oblige you too. They usually charge around 500 quid for that.

    So firstly we need to establish what exactly the invoice is for. I doubt if Joseph James even knows but if you have any correspondence (or the invoice itself) form FTR then by all means I'll take a look and give you my thoughts. It's nick@legalbeaglesgroup.com

    Don't worry about deadlines from Joseph James. They're just two bit debt collectors and in my experience never follow through with their hollow legal threats.

        Before I can advise on the next steps, some questions:

        1 Did you ever receive a PPI refund from Santander?

        2 Did you ever receive a final response letter from Santander regarding the PPI claim?

        3 What type of account did you have with Santander?

        4 Do you still have the account with Santander?

          I can confidently say I haven’t had any PPI, I have also since changed bank and not sure if I can show this?

          2 Did you ever receive a final response letter from Santander regarding the PPI claim?
          Haven’t had any correspondence from Santander at all As I’ve never used them.

          3 What type of account did you have with Santander?
          I’ve never had an account with Santander.

          4 Do you still have the account with Santander?
          as above never had account with them.

          I’ve also checked with o/h to in case my memory serves me wrong,m and just as certain we’ve never had PPI, never had account with Santander etc.

            Ok thanks.

            In the email from Joseph James it mentions 'Storecards - Santander PPI'. So it might be a storecard for a particular store that is actually run by Santander but goes under the name of the store, so do you have any storecards that might be it?

            Also there is the FTR letter of authority that is specifically for Santander. I appreciate you don't recall signing it (albeit digitally) but would you have entered 'Santander' in the free PPI check enquiry form if you never had a Santander account (or didn't know you had a Santander run storecard)?

            Sorry for all the questions but I'm trying to maximise your chances of making a successful formal complaint to FTR.

              yes potentially store cards that may have been with Santander then, but I never would have known that and did not put that down/enter that specifically to be checked.

                Yes I think we're there.

                Leave it with me and I'll draft a formal complaint to FTR and then you can also send a copy to JJ telling them that until such time as the prescribed formal complaints process has run it's course, it would not be appropriate for them to continue to pursue you for payment.

                Obviously should FTR reject it you can then refer it to the Financial Ombudsman.

                Also, just as a belts & braces, I would write to Santander asking them to confirm if they have ever dealt with a PPI claim from Quickly Finance trading as Fast Track Reclaim for a Santander Storecard on your behalf and if so, what the outcome was. Don't forget to quote FTR's ref number for the claim which is CA1412145. You'll need to provide your full name and address. Their email is customerservices@santanderconsumer.co.uk

                      I am having similar issues with the same company, I received no PPI from Santander but Joseph James Law are now threatening to take legal action as I am unable to provide a final decision letter.
                      Do I have any options?

                        If you didn't receive a final response letter from Santander then you need to file a formal complaint to FTR on the basis that it is not reasonable for them to demand something from you that either you never received or doesn't exist. If they reject it then file the complaint with the Financial Ombudsman. At the same time write to JJL telling them that you've made a formal complaint and that until such time as the complaints process has run its course it would not be appropriate for them to continue to pursue you for payment.

                        Also it would be wise to write to Santander asking them if FTR made a PPI claim on your behalf and if so to provide their response to it.
