  • Lowell/ Overdales Court Judgement: 3 Mobile 15/16

    Hi All,

    Firstly thank you for your time!

    In proceedings, a credit check report via Checkmyfiles website I noticed two debits appears on my credit entry from Lowell that I have never taken. First one for Tesco mobile of £356 dated 2017 (which had my last name shortened or used an alias) I’m currently disputing this has an identity theft.

    The 3 Mobile 01/04/2015 for sums totalling £562.42 held in my official name, DOB, postal address.

    I immediately the telecommunications company who told me they had nothing on under my details and this debits information. Soon after I called Lowell, in very short summary, I was told that even though the 3 Mobile case was still owned by Lowell they hand-down to Overdales who acted for their successful defendants v myself (not been present during the case hearing nor unaware of the court case against me) on 04/02/2020 at the County Court Business Center in Southampton.

    I explained to them that this was a basis of fraudulent misrepresentation. In all the circumstances, I have never received any phone calls, emails or letters in regards to these mysterious debits. Lowell saying to have tried to contact me repeatedly but with no success.


    Having moved homes 16 times in 15 years (I am a EU citizen/non British) I informed them that no submissions were made to me in this connection and I requested that they provide all the information they hold on me with proofs of all back dated “correspondences” by email or post and had refused.


    I asked them stop any further action and provided them with my crime ref from Action Fraud to investigate my complaint about identity theft in order to rectify the error on their file and have the debts + court judgment removed from my credit entry report.


    They said since the case was now appointed to Overdales I had to reach out to them instead for further information.


    While on call with Overdales I request my GDPR to be sent and they subsequently dismissed my request. Because the Court gave an order for me to make instalment repayment of £100 PM. However, they have allowed me 14 days to sick legal advice and asked I get back to them with updates before sending the beliefs to my property.


    For the time being I wrote an email to 3 Mobile (and Tesco) for Subject Access Request. And contact the credit reference agency Equifax and tell them I’m a victim of identity fraud. They are currently investigating this records with Lowell.


    Looking at the account defaulted status on 08/12/2016 once there was a risk that debit was getting closed to the end. Lowell move the case to Overdales to handle in direct response to that threat.


    Please kindly advised for the best course of action. How can I dispute their information since it's a result of fraud and identity theft? Do I still have the chance to appeal the Court decision made in 2020 so that I can get my financial life back on track?


    I would be grateful for any help and insights to have this court judgement cleared and get that error so my credit reports can be corrected. This is causing a great deal of stressful.
