  • Help with a Court County Judgement (CCJ)

    Hi,

    I was recently given a Court County Judgement (CCJ) for a debt that I was unaware that I had - the debt was for (roughly) £300 for unpaid car insurance almost 5 years ago.

    I was issued the CCJ in May 2022 via letters that were sent to a residence that I no longer live in and they weren't forwarded to me by whoever lives there now. I moved out almost 3 months prior (February 2022) and had no idea that the CCJ existed until I went back to the residence last month (August) to pick up some stuff.

    I instantly paid the debt when I became aware but then when I emailed the court to ask for the CCJ to be removed, they told me that it will stay on my record for at least 6 years which I find incredibly unfair.

    I was wondering if anybody would give me any advice on how to appeal this and get the CCJ off my record? I have given as much detail as I can recall, I hope I have explained everything.

    You shouldn't have paid until the Court ordered the CCJ to be set a side.

    You should have sought consent from the Creditor, if they agreed to consent to the set a side, then the Court fee would be just over £100. If the Creditor refuses consent, as there is no incentive for them to consent as you have already paid the debt, the fee will be just over £275.

    As you have already paid the debt the Court may not agree to set a side the CCJ.

    a) Contact the Creditor in writing, get Proof of Postage explain that the Court papers were sent to the wrong address, that the debt has been paid, you want them to consent to set a side the CCJ. Update the thread with what they say.

      Hi ECHAT,

      thanks so much for responding to me. I'm very oblivious to all of this so I wasn't aware that paying straight away would be detrimental to my case.

      When I spoke to the Creditor on the phone, he said that they are consenting and that it would take 6-8 weeks for the CCJ to be set aside - but he would do his best to fast-track it to be done earlier. Unfortunately this wasn't in writing. However, I did receive this email once I chased up a few days after making the payment:

      'Thank you for your email.

      We can confirm that we have received your payment on the 27th July 2022, and that this has cleared the outstanding balance. We electronically notify the courts to let them know that the balance has been cleared, it is the court who report to the credit reference agencies and will have your Judgment upgraded to satisfied. Please allow 6-8 weeks for this update to be reflected on your credit file. In the meantime, we attach a statement of your account confirming that the balance has been cleared. Once the Judgment has been marked as satisfied, you may request the courts to send you a certificate of satisfaction.'
