    I am a defendant on county court hearing due for trial at the end of the month. I heard from my solicitor last week that the claim was struck out due to the claimant failing to pay the court hearing fees.

    They have applied for the case to be reinstated as relief for their “mistake” my side have maintained that the case should not be reinstated, on the basis that we should not be forced to make changes at the last minute due to their error.

    How likely is the case going to be reinstated? It was a very minor bump they are claiming for.

    Sorry, but reinstatement is very likely. I have seen it happen several times. Your solicitor may be able to get some small costs of the hearing of the application to reinstate.

      Thanks, it’s very frustrating when I thought it was nearing the end. My defence is strong whilst their statements are full of errors. Another long wait for me then
