    My car insurance instructed a recovery agent to recover my car to a car repairers that they also instructed. The car has come back to me (5 weeks), with a boot full of oil. It looks like the car oil bottle i had in the boot has either fallen over when the car was picked up or set down (twice), or the mechanics have been in the boot and picked the boot liner up and the bottle has fallen over (although i left the locking wheel nut in the tray under the handbrake so they didn't have to look for it, plus the boot liner was up so obviously someone has been in it. I have the bottle in a plastic box with other bits and pieces and it's never fallen over. The screw top is on properly, and not cross threaded. Because it was on its side for so long, i think it has seeped out gradually over the 5 weeks that they have had the car. The recovery agents and the repair centre are both denying it was either of them.
    If i open a small claims case, do i put the car insurance down as the defendant, as it was them that instructed he recovery agent and car repair garage?? The cost for a new liner and oil damage to certain items that were in the boot, is £1,049.00.

    Why not include both the Insurance and the Garage on the claim and take them both to Court.

      It could also have been the recovery agent. I was wondering if it would have just been the Insurance Company, as they instructed the repair garage and recovery agent, so in effect, they were working for the Insurance Co.
