  • Rejection of car within 30 days

Hi I am trying to sort out an issue for my son, he bought a car from a car broker who arranged a HP agreement with a finance company.
After he had the car a week I realised that he would end up paying a third of the cars value in interest, my son asked to take the car back under the cooling off period not realising this was just for the car and not the finance.
The finance was paid off from a personal loan from me and my son is paying me back.
Few days after settling the finance we realised that the car does not have the full service history that the car had been sold with, the advert says full service history and just been serviced ( that was almost 2 years ago!) We sent a letter within 30 days to reject the car under the consumer goods act as it was not sold as described.
The car broker and the finance company are refusing to help.
I have tried citzen advice on a few occasions, i have been told the Finance company are the people that need to sort it as the HP contract was with them and now financed settled as if buying from them, another lady said it is both and another wasn't to sure.
    can anyone help please?
    Thanks

My opinion on what its worth, write to the Finance Company,(keep proof of posting) and send SAR for all transactions, also point out the car was returned to the Dealer, and as allowed 30 days, as not as described and so you require a full refund of the Finance payment, Depending on the reply consider Small Claims Court
