  • Private water supply.

    Hi, I have a private water supply from a reservoir outside of the property, my neighbours supply is piped just below the surface through the whole length of my garden into their property. Hence there is a lot of my garden that I cannot cultivate. Is it legal for me to ask them to remove the supply and reroute it?

    To answer that, it will be necessary to examine whether your land is subject to easements. But of course you can negotiate a re-routing of the supply. Be prepared to contribute to the cost.

      Unllikely. You need to check your deeds and th eregisters. If things have been done correctly there will be, as Atti says, easements which very likely specify the route of the pipeline. An easement gives hime the legal rights across that specific bit of land.

      If there is no formal easement, then you, and they, need one, and it is in the interests of both of you to have one. Uncertainity damages the value of both properties.

      That you know enough about the pipeline suggests that there is an easement. The wording needs to be checked.
      Things can always be changed by negotiation, but you are the one wanting to make the change and start on the back-foot

        It might be easier to have the supply pipe buried at the correct depth (750mm?).
        If it is just beneath the surface you could point out to your neighbour that in the event of a heavy prolonged frost he might be without a water supply.
