  • Advice please regarding dwp mandatory reconsideration housing element

    Good Evening All,
New to the Forum, and wondering if anyone could help please ?
Im in receipt of Universal Credit & In the LCWRA group, as I have various mental health problems.
Basically, when I first claimed UC, I made a mistake, on the online form, as I put Supported housing, not Rented option.
I didn't change It, as I was told that my rent, would need to be paid for, using my UC monthly payment.
This went on, for 2 years, paying my rent, from my UC & PIP payment, not receiving any Housing support, as I didn't know it was available.
When I moved house, In October 2021, I was asked for my Housing Costs details. I was surprised at this, as I wasn't aware of being able to claim for this previously.
So this Is when I asked about a reconsideration, for the previous property. After 1 week, I was sent a letter, stating that, It will not be considered, as It's out of the Time Frame, for reconsiderations.
It has to be done, within 1 year, which I also wasn't aware of.
I do remember telling the PIP advisor, that I lived In Rented accommodation, when I was going through, my assessment. I also remember that this was stated, In my assessment report.
Should this have been rectified, by the DWP ?
Im fully aware, that It was my mistake, but I wasn't aware, of Housing support, as I was told that I would have to pay my rent, from my UC & PIP payment.
I am In the Support group, and I do find It difficult to understand some areas of the benefits system, without help. Would this not be a good enough reason, for them to reconsider ?
Thank you in advance, for any advice, Its most appreciated

It is possible to request a mandatory reconsideration out of time, but it is for DWP to decide whether or not to accept it.

Being unaware of the law is not accepted as a good reason
