Who Owns the Pavement ?

Hello Helpful people.
We have had a slight issue with a neighbour over the road.
He seems to think he owns the section of pavement out the back of his property?
There is no rear access to his garden and its half wall half fence.
As far as we can tell he has no legal right to say he owns this land?

If that pavement is part of a public highway, it is possible that he does own the subsurface to the centre of the highway.
However he will not own the surface, and at the end of the day his claim to legal ownership gives him no privileges.
