  • Self Employed Payments

    If you’re self employed for a company. And you’re expected to arrive at a location (base) well before a ‘contracted’ shift stars. To then check the vehicle and equipment for that shift. And drive over to the area where the ‘contracted shift’ starts. Must you be paid? As driving a works vehicle? Any legalities or insurance issues if not paid.

    example. Your shift is a 07:00-19:00, but it’s a 30 mins drive to where this shift starts from the vehicle base. Some equipment and vehicle need checking prior to leaving, taking about 20 mins. So expected to arrive 06:10. But NOT Paid until 07:00. Are there any issues (apart from morally) wrong with this?

    Although you have raised this as an issue you have, in what you have posted, raised a concern about your employment status as being self employed.

    If terms are being dictated to you about start finishing times, you are querying payment for driving and checking equipment which is being provided to you for doing the job by the company contracting you for your services, then you are potentially crossing the line into being an employee.

    This may not be the response you are looking for but this is an important issue to consider for your employment status.
