  • Damp Guarantee

    Hi

I had a national company complete a damp survey on my home and off the back of the survey came a report on what treatment and work was required to remedy the problem. I went with the same company to do the work and ultimately got a 25year guarantee

2 years later I still have a damp problem, contact the guarantee number and was asked for £195 for them to come and inspect my concerns

I wasn't happy to have to pay £195 for them to come a survey there own work so started doing my own research and asking questions of other companies to build my knowledge on damp proofing and plastering etc and I ended up coming across the relevant British Standard “British Standard (BS6576:2005+A1:2012) Code of practice for diagnosis of rising damp in walls of buildings and installation of chemical damp-proof course”

Off the back of reading the standard several times I firmly believe that the company who did the work in my home has fallen well short of satisfying the minimum standard set out in the British Standard.

Off the back of me raised this to the company about the British Standard and falling short they sent there Regional Manager to inspect there work (without me paying the £195) I think this in its own right tells me they know they have failed on the standard. But despite this they are still trying to cloud the situation in damp talk jargon and offering to do works where they have fallen short but I don't believe they are offering to do all the right areas they should be doing and are saying as a wood will gesture they will supply the materials if I pay the labour, but this is still only in a small part of my home.

In the 2 years since the substandard survey which I believe was incomplete and none compliant with the essential requirements I've spent a lot of money doing up and decorating my home and don't see why I should have this cost a second time.

    I suppose my question are
    - Where do I go from here?
    - What legal strength does a British Standard have

    Thanx

First of all I suggest that you speak with the person concerned and let them know that you expect the remedial work to be carried out at their expense. and if they do not agree, that you will ask the Trading Standards to offer their view. I think you will get the work done, but make sure you have it in writing that the repair is simply correcting their error and still carries the same guarantee

Let the forum know what happens please and perhaps other members may wish to add to your question..

I would think if you don't obtain satisfaction you would have a claim against them as the service has not been performed with reasonable care and skill.
Consumer Rights Act 2015 Chapter 4 Services applies
