  • Builder dispute

    I have a dispute with a builder. He gave me a quote which I accepted to refurbish my house and he started work on 30 September. I made intermittent payments. As the work began I wasn't happy with the workmanship so I removed some of the items from the quote (x3 storage cupboards and a bedbase). He credited me an amount which I wasn't happy with and also suddenly added on extras, so I questioned it with him and he won't budge on the amount or the extras. I said I was withholding the final payment until I get quotes from other builders to know that the final amount credited was fair. While waiting for the quotes, his wife and daughter have blocked my car as I drove from my house and threatening me, and the builder has sent an email threatening CCJ against me. He is now adding daily interest on outstanding amount and informed me that the materials used remain his property until the full amount is paid. I want to know my consumer rights in this case, am I legal in withholding the final amount while I got the other quotes? Can he return and take back materials (this would be plywood and timber) (I supplied all other materials - kitchen/bathroom). He also hasn't supplied us with a electric safety certificate as he re-sited our main fuse box. I have since had quotes from other builders which is more than the original builder has credited me. I have emailed him to let him know that I want more credited and the electric safety certificate, I'm waiting for his reply. He is aggressive and has been throughout the last 4 months building work and workmanship has not been to a very good standard.

    You are covered by the Consumer Rights Act 2015. The work has to be done to a satisfactory standard.

    You can amend the following template to suit your circumstances. What you can also do is contact CAB / Trading Standards, they will advise on the complaint, but they will also give you a Reference number, write the following on the template:

    Complaint Ref: CAB / Trading Standards: XXXXXXXXXXX

    That should cut out the aggressive behaviour.
