  • Legal loan advice please

    Hi I really need advice. I paid a loan off last year and since then the company has new owners and sent a bill of £3000( half the original loan amount) threatening legal actions if I don't get a loan and pay it off. Wouldn't accept a cash payment, only monthly installments from a loan would be accepted. I have bank statements to prove paid loan but currently looking for loan paperwork. What would you suggest here. I'm not confident or legally savvy. Really need advice please. Kind regards

    "I have bank statements to prove paid loan "........................... So as long as your bank shows payments to their account/bank, then ignor the threats.

    Send a letter by recorded delivery and keep a copy. Say you have proof that payments were made to their account and suggest that they check their records.

    If you have paid you have nothing at all to worry about and they can do nothing.

      You need to locate the document showing the final acceptance clearly showing that was the final agreement, you have the proof of amount paid so that's a start.

        If you need information form any party, you could consider sending a SAR, they have 30 days to provide all the data on the account over a 6 year period - the template is in the panel to the right of your screen.

        Don't be scared to make a Formal Complaint, if it isn't resolved you can escalate the matter to the Financial Ombudsman Service.

            There is no time limit on requesting a SAR, the company should provide data for at least 6 years, it could be more then 6 years if it's available.

              Subject Access Request Lette

              just HMRC informations a company must keep records for?:-


              You must keep records for 6 years from the end of the last company financial year they relate to, or longer if: they show a transaction that covers more than one of the company's accounting periods. so some may say customers last payment records may be unavailable? but could lead to a problem both sides??? just a thought!

                    no reply? then after 30+ days complaint to ICO can do it on line? it is a regulated request.

                      Thanks, Mike Request was sent to the Legal Dept. I was supplied no reply. Very big Insurance Co so they thought it will not apply to them, now making follow up letter.

                        They are outstanding a legal request (their Data controller responsibility.) therefore they could be fined heavy. just make a complaint to the Information commissioners office. Make a complaint | ICO

                        DSARs must be fulfilled “without undue delay”, and at the latest within one month of receipt. Where requests are complex or numerous, organisations are permitted to extend the deadline to three months. However, they must still respond to the request within a month and explain why the extension is necessary
