    Hi there,


    Back in December 2021 i received a form from the county court telling me that a claim has been submitted by the solicitors of Cabot financial in regards to an outstanding balance. This came as a surprise to me as i had written a letter to Cabot some time earlier but was waiting to hear back. I assumed they were delayed or very busy with covid-19 issues. At this time i was having issues with mail being delivered by royal mail in my area so i suppose its possible it happened in other areas too.

    Once i got the letter from the court i emailed the solicitors that started the claim straight away and explained that i was not aware it had gone this far, I explained very personal circumstances to them in my reply. Sadly at the time i was going through the worry of having another miscarriage.

    I waited for a reply and as a few days passed i emailed again as i was feeling very upset and distressed at the worry of this going to court. I still did not get a reply and some more time had passed and i was starting to feel helpless, the stress and worry was affecting sleeping and i wasn't eating properly and i felt very unwell with all the worry.

    Eventually i got a reply and i was somewhat relieved to get the reply up until i read it. The reply i got simply stated to complete the court forms and its our intention to issue a judgement against you. My heart dropped and i have never felt so low in my life. With everything that was going on at the time. I also have epilepsy too and have issues with this and i made them aware of all of this.

    I explained in as much detail everything that was going on and how much distress and upset all of this was causing me on top of what was already a tough time. This is why i was so let down by the reply that i got.

    I then went to Cabot and explained the whole situation to them and they immediately recalled it back which was a huge huge relief. They let me deal with them directly without it going through court. They also told me that the solicitors should not of let it get that far.

    I made a complaint with the solicitors on how it was dealt with. My complaint was in regards to how much upset and worry it caused me and that the reply they gave me was unhelpful and vague. I got their final response and they upheld part of the complaint, They apologised for the distress and upset caused and said they should of asked for further documentary evidence to pass back to cabot. They did not uphold the part of the complaint where i said their reply was vague and unhelpful. They offered £50 compensation.

    I replied and disputed their reply. I felt that after all of the personal information i had given them that to reply with what they did was unhelpful, Surely its a contradiction to uphold part of the complaint by saying they should of done something differently instead of replying to me in the way that they did?

    I feel they don't understand how low i felt with all of it and they wrote back and offered £250 compensation. Previously i was advised to settle the complaint with £750 compensation. I am unsure what approach to take. Is the £250 fair for the upset and distress i went through? Is it fair to not uphold the part of the complaint that their initial reply to me after all i said was not vague or unhelpful.

    Any help / advice would very much be appreciate. I have not yet accepted anything and i'm trying to get advice on what's fair or if i should pursue further.
