I would be grateful for direction, please
I submittied an SAR to my gp practice for my medical records.
the most significant medical record was recorded as having been recieved, but was not present.
i then approached the ICO. They have upheld my complaint.
I was advised to submit a second sar, to check my mothers medical records for records related to me, including birth records.
The practice manager called me to say that my mothers medical records, begin when i turned 18. Despite her having arrived in the UK under 1 year, before i was born. 19 years of UK medical records.
At 18, I lost my father and any questions related to my health, were met with ''your father dealt with those things''
My Birth mother was employed as a medical receptionist at our gp surgery for over a decade.
My uncle was a senior partner and my gp at the surgery.
I know that my Uncle and my mother have removed these records.
I have suffered mental and physical abuse as a child and was always told there was something wrong with me.
Which family have reienforced all my life and my birth mother claims to also have no knowledge of. However, when asked about other aspects of her life, before and after, she recalls these details in perfect clarity.
I have requested councelling from my uncle at various stages of my life and always told that it would 'do me, more harm, than good'. Even when the opportunity to have councelling, came up, as a consequence of my work.
At 3 months old, I had Gastroenteritis and spent 20 days in hospital, as per the hand written record of my hospital stay, not the missing hospital report.
I asked my mother where the missing hospital record was and she replied that I had Diaoreah and she spent 1 night in hospital with me because my father told her to! She then wished me Luck in getting hold of the missing record.
Following an extensive search of approximately 600 photos covering my mothers life, there are none of me being held by her, as a baby.
i have a significant defect, that my birth mother claims no knowledge of. First recorded on my medical record when i was 13 and the cause of me not being able to pursue a career path I had trained for 3 years, together with the related mental health issues, which have never been discussed and always deferred.
I have suffered from depression all my life, including a deep 5 year depression. Suicidal thoughts and attempts throughout my life. I am totally estranged from my entire family, following a sustained 5 year period of depression. I have never had friends for more than 3 years at a time. I have over 20 failed relationships, including my most recent 6 year relationship.
I am unable to sustain relationships, of any type.
I have been advised that I can approach a no win no fee lawyer, to pusue a case against the NHS, for the missing medical records.
I understand that the NHS is ultimately responsible, but I would like to know if I am also able to pursue the people directly responsible, in the same action. I have suffered at their hands for my entire life and always covered up or tried to move on, each time. I will never get the answers I need to be able to move on completely with my life.
So, I need them to see that, at the very least, they must be held responsible for their actions, under UK Law, even if only for tampering with medical records.
