Hi, quick question please. We comtracted a local kitchen designer to design, oversee and install a new kitchen. There have been many issues and we are now in court proceedings. He has mounted his defence but said that one of the issues (unsafe installation of cooker due to mantle being incorrectly built dimensions wise for gas safety) that his contractor, the plumber is liable. He’s stating that as the cooker and the marble surrounds were paid for by us it has nothing to,do,with him, although he instructed the fit, designed the mantle and his contractors acted solely on his instruction and were laid by him. The only thing is the gas safety report says to make it gas safe it is the plumber they would hold accountable as he has defectively signed it off, but we have never instructed or contracted or,paid his plumber for any work and our solicitor stated our contract was with the designer not his contractors . I should say the reason is has gone to court is the designer has had over 18 months and two failed attempts at trying to,fit this kitchen to a reasonable standard. I just wondered how a judge might see who is liable.

You contracted the designer, the designer contracted the plumber. So the designer is responsible for the building / Gas Safe issues. He simply 'can't pass the buck' because it suits him to do so.
