  • CCJ for not buying something on e bay..incredible but true..

I bid on and won something on ebay. When I got the invoice it had 20% vat added to it even though the item was 'located in the uk'. When e bay investigated they found that the item was in Cyprus. They said I could withdraw from the sale. About 6 weeks later I got a claim from from MCOL asking me to respond to a claim. It arrived 2 days after the deadline expired. 4 weeks later I got a default CCJ issued against me. I am asking for a set aside and have paid the £275 and submitted the N244 form. I cannot see that this is anything other than a case of 'Vexatious Litigant' or vindictive Litigant. The seller was pissed off because e bay allowed me to withdraw and yet he was claiming £300 for the goods which he still had!!
If the judge or court sets aside the CCJ can I ask for the claimant to be required to pay my fees.?? Apart from anything else the claimant did not observe protocols such as sending me a letter of default (sent e mails to e bay instead).
