    Hi,
    I have won a small claims court claim against a big company. The cheque they sent me is short by a very small amount.
    This company put me through a huge amount of hassle and inconvenience and I am not in the mood to play nice. All good will has been well and truly used up.
    Because of the Christmas bank holidays their cheque cannot clear in time to not get a CCJ.

    Am I under any obligation to tell them it is for the wrong amount? I am happy to delay paying in this cheque as it is not for the full amount.
    If they attempt to claim to court they have paid the full amount, will me delaying this response and then telling the court that the total amount is short when they attempt to resolve their CCJ cause me a problem? Will this company end up with 6 years of CCJ?
    I'm just interested in the legal opinion.

    Show willing and send it back to them immediately pointing out their error and demand the correct sum by return.

    Just be able to show you acted reasonably. Make sure when you post it back it's first class and you get a free certificate of posting from a post office.

    They could be playing awkward out of spite, or a member of staff showing how much power he has without knowing the consequences.

    I had a defendant that paid at the last moment, after banking hours, on a Friday before a bank holiday and demanded a receipt. He went away with a flea in his ear.
