  • RTC Compensation query

    Hi all,

    Recently I have been involved in a dispute with another party over a Road Traffic Collision. My claim has been settled on a 'non prejudiced' 100% compensation basis. So I will be fully compensated. However, my wife who was a passenger in my car is represented by a different solicitor (for conflict of interest purposes if it went to court).
    My query is regarding her claim, now that it has been settled in my case will she be compensated by the other side or something else?
    From what I have understood as the innocent party she kind of has to be compensated, I am just unsure what will happen?
    If anyone has any experience of this I hope you can help

      Your successful claim should have no effect on the claim your wife is making.

      Presumably the third party insurer is paying the successful claims

        Thank you for your replies, will that still be the case even though they ‘aren’t prejudiced’ in the decision?

          Your claim, which has been settled by the third party insurer without accepting liability (ie non prejudice) should have no effect on the other claim.
          The fact they settled your claim cannot be used against them as proof of their liability to your wife.
          Her claim is completely separate
