You always have the right to pursue a rejection claim, but whether you will win or lose we cannot possibly guess.

If the vehicle is unsatisfactory (i.e. it meets the standard that a reasonable person would consider satisfactory, taking all things into account) or was misrepresented you may well be successful.

However we do not know enough about the situation to make a guess as to your chances of success.

A hole in the floor is not automatically a MoT failure as it depends on its relation to other parts of the car EG sills, seat belt anchor points, suspension etc etc.
What is satisfactory depends on , among other things, age & mileage of car, price paid

Just speculating, is it possible to get a foot 'caught' in it and trip / fall (with or without the matting)?

There is no way the dealer / motor technicians didn't know about it.

Update to this - we still have had no update from the dealership with regards to organising a repair or replacement vehicle. It would be good to know my rights and how long legally they have to respond to my initial email sent to them on 18/11 highlighting my concerns. Feel really let down and the broker just seem to be constantly fobbing us off saying they can't get through to the dealership .... how long can this go on for?!

Also have we now lost our right to reject the vehicle seeing as the 30 days has now passed and the garage have not responded?

Did you 'contact CAB / Trading Standards, tell them about the 'hole', the dealer didn't tell you about it, they will give you some advice, but also a Reference number'?

Does the Dealership and the Finance Company have a Twitter, Facebook or other social media accounts?

I personally would be promoting the purchase you made, especially the image of the 'hole' in car, see if that moves the Dealership / Finance company to act.

As you've rejected it within the correct period, you don't lose the right to reject.
