First time poster looking for some advice. I've fallen foul of backdoor CCJ from an old DCA. Moved house start of the year, forgot to notify DCA because it hadn't crossed my mind as I hadn't any letter off them in over 2 years since they acknowledged they were unable to provide the CCA and account was unenforceable.
Only found out about CCJ from credit report last week. Weird thing is, received letter with court costs from them to my current address only 2 weeks after they filed claim. I hadn't realised what letter was, it was something about a notice of default sums.. if only I had known better. My current address has been on my credit report since Feb this year.
I believe I have a good chance of having it set aside with the fact they "found" my address so soon after filing claim, and my proof they were unable to produce CCA.
Is it worth asking DCA to agree to put it aside given the evidence I have? I cannot see it happening given they're awful.
Also, is it still custom to complete a witness statement etc. or can I simply fill in the box on the form.
