  • New houses on a highway not maintainable at public expense) - road to be made up

I live on an unadopted road. The seven houses on our side of the road were built between 1905 and 1910. There are two houses on the other side, at one end, of the road, both built around 1920.
I am advised that if more houses are built to infill the gap on the other side of the road between the two houses then the developer will be required to make up the road for adoption by the Highway Authority, at no expense to the existing frontagers.
Is this correct, and if so, where can I find the legislation?
    Thanks.
