  • Am I legally bound to pay back a non-contractual gift to an ex-girlfriend?

    Hello.

Not sure what forum section to post this in.

Just split up from my girlfriend. When I originally quit my job to move in with her she initially helped me out with three payments of £800 (over three months). She has a very large income and at the time was happy to help me out. This was intended as a no issue help to cover living costs while I took a small break with a health issue. Now we have split she is asking for that money back. There was never any indication it was a loan, it was a freely given helpful gift. Do I have any legal obligation to give that money back? She's also left all my items (including expensive TVs, computers etc etc) in the back garden for me to collect and im sure its going to be damaged when I get there. Surely that cant be legal?

    Kind Regards.

    Feisty.

A gift is a gift and there is no legal obligation to return it.
Whilst there is no written loan contract it will be difficult (but not necessarily impossible) for her to win a court claim for its return

Regarding your chattels she has an obligation to take reasonable care of them, and if she fails you could claim for your loss
