  • Recovering costs

Hello Can any one help please I have just won a Civil court case for a beneficial interest in my home, over 3 years and a 3 day court hearing with costs standing at over £21,000. I was the defendant and the case was fully dismissed with "Costs to be assessed if not agreed "awarded to myself, The judgement was almost 2 weeks ago and I assumed I would receive at least a letter or advice on how I now go about recovering these cost or some of them. My Barrister said on the day, "Maybe just draw a line under it and move on" Surely I have some right of redress ? In brief the other side was an ex partner who has 2 homes in the UK and a business in the UK, He now lives in Spain. Both of his properties are tenanted one is mortgage free, The business was put into voluntary liquidation this month apparently although I have not seen any evidence of that, but am sure the business is closed. He would of needed to evidence he has money in order to achieve residency in Spain. The other side acted as a LIP as he was fully aware he had no chance of winning so paid the standard court fees totalling under £2000.00, where as I was forced into defending myself, mediation to stop all this going to court was taken off the table very early on due to violence issues on his side in the past. I do feel like I was just forced to go through 3 years of hell and made to use all my savings for him to just jump straight back on a plane and not have any concequences for what he initiated. I just need a starting point if anyone can advice Thank You

A brief outline on getting your costs assessed: https://www.gov.uk/assess-approve-court-costs

If payment isn't forthcoming, a costs award can be enforced overseas, but isn't always that easy.
On the other hand you might be able to get a charging order on one of his houses and then an order for sale.
