  • Standard Basis Assesment costs ..how does it work

    My friend got costs awarded in a high court cases on a standard basis with an interim payment order also.

    The interim payment has not been paid on time and is one month late and the loosing party is not communicating.

    There was some talk that he had to agree to standard basis before interim payment by losing party but we think this is only distraction as the judge decided the basis.

    How is the standard Basis done , does it need lawyers on both sides ? Both parties had finished up with their lawyers.

    Will the court remind him of his dues or he needs to get High court baliffs ?

    And without the assesment can he only get Baliffs for the interim amount ?

    You would likely need to commence detailed assessment proceedings (of your friend's costs) to progress this. Are you able to upload the Order made?

      IT IS ORDERED THAT
      The first respondent to pay the costs of the application on a standard basis to be assessed if not
      agreed.
      He shall pay £8000 on account by no later than 26th August 2021.

        Eventually the interim payment was made and now it is a battle over the other fees. Hard work
