  • Indirect Discrimination

I am trying to keep this simple. I am acting on my mother's behalf as a person with a protected characteristic. We are about to have mediations with a retailer for the following,

    1. Breach of contract, failing to supply a wheelchair as described at point of purchase and not fit for purpose.

    2. This has lead to a breach of the equality act 2010 by failing to provide an auxiliary aid as well as a PCP by failing to make reasonable adjustments allowing a disabled person left with minimal mobility as a result of contract breach to access their services and complaints.

    3. Discrimination by association by failing to provide any reasonable adjustments to the pursuers son after he informed the defendant of his dyspraxia. Failing to make any reasonable adjustments meant the defenders son was left acting unaided on his mother's behalf to find a resolution. This in turn resulted in a formal letter being produced from his GP declaring stress related issues.

I have over the last 3 year attempted to resolve as well as heavily documented and compiled evidence in the bucket load to support our case.

My question is simple, we are about to mediate and I need figures as to how mutch we should be looking to settle for? A good ball park would be helpful I know disability claims are uncapped but trying to be real.

    Thanks

    Hi PHOSPHOR

Mediation is all about looking to resolve the matter without the need for a Hearing and everything that entails, the only way that happens is if both parties are willing to be flexible on settlement amounts etc.

Here is a Guide with examples (there will be other similar documents on the net), only you know the in's and out's of your case and what you are willing to settle for -
