    Hi ANDYP358

Your mother is ill / elderly and as such is a 'vulnerable persons', you need to let Newlyn and the Council know that in writing. Email it to them, followed up by a phone call.

You should if possible, pay the Council directly, but check that the amounts asked for are owed and correct.

Thanks again, a little more info is, been in touch with the council and told them about newlyn, and my mothers situ, they sent a bill for the parking offence but did not mention informing newlyn that they were take back ownership of the debt. As for contact with them both, before i took the case my mother contacted a family friend who contacted newlyn and the told her my mother would have to prove she is sick with a list of details... Is that not a data breach, telling someone's case details to someone else.??? That is when i decided to contact the council on behalf of my mother, and not contact newlyn untill i had some kind of arrangement sorted. My mother when to the her doctor who gave her a detailed letter of her conditions, so i have take to send to the council. The trouble is, do i send it to newlyn .? As they breached her data protection rights, is there something that can be done to them on those grounds.?

Send the Doctors letter to the Council (send them a photocopy, keep the original), once they receive the Doctors letter the Council should take back the debt. You need to get confirmation they have received the Doctor's Letter, so might be best to scan and email it.

Send Newlyn's a letter via email telling them that the Council has been provided with a Doctors letter regarding your mother's illnesses / conditions, so should recall the debt. They should put the matter on hold.

You can contact the ICO, they have a great 'online chat facility'.
