  • Mediation?

    I have been offered mediation for a small claim made against me for a loan that does not exist -
    so do I still have to go to mediation? I’ve read that it goes against you if you do not accept mediation but as I’ve got nothing to mediate I don’t see why / what would be the benefit.
    I am not accepting the case against me as I don’t know the person who is making the claim I have never met or spoken to the person in my life. Totally fabricated. I am not negotiating anything.

    If you are not prepared to mediate (and I wouldn't in your case) there is no point in agreeing to it.
    All you will do is waste the mediator's time, as he will cancel the call as soon as he hears you will not agree a compromise.

    Altho' the courts expect every effort to be made prior to a hearing, your declinature of mediation will have no affect on the hearing
