Hi there,
I am unsure what to do so please bear with my ignorance in legal matters.
I just received a country court money claims form against me for the value of approx £4,000 (comprising of vehicle repairs, bi-lateral hire, recovery and towing)
This is from a private claimaint for "damages for negligence and or breach of statutory duty arising out of an accident which occured on xx April 2018"
Context:
Back in April 2018, I was involved in a car accident. I sustained back and neck injuries.
My insurers advised I go with a legal firm to claim for injury.
A lot of back and forth between April 2018 and now (horrendous legal firm)
Have had to wait for medical to get back to me due to COVID
Still ongoing...
Now I'm being pursued privately it seems?
What do I do?
Kind regards
stop duplicating post stick to original, it is the weekend and we are volunteers be patient but stick to original thread.

Sorry could you clarify something further, are you being sued by the individuals you were in an accident with? if so, do you have any sort of defence to their claims?
If you contest the amount of the payment but not the actual incident and your culpability then your best bet would be to negotiate a lower sum that suits you both that you could pay in instalments.
hope this cleared some things up for you
Hi Gerard55
Did you report the accident to your insurers at the time (in 2018)?
I did, yes. I have now spoken to my (then) insurer and as far as I am aware, they are the ones who deal with the court letters. Which I have now sent to them to take care of
This is a duplicate thread and there are answers on the other thread as well

We offered part 36 but I assume we did not get any response

Pass it over to your insurers directly.
Only acknowledge the claim and do not enter a defence.
Tell your insurers you have acknowledged it, and keep a check on it to make sure it is not overlooked and you get a default judgment
Keep it in writing and keep copies
Thank you for your reply. I have spoken to my insurers and also asked for advice on MSE forum, and as I understand it, I should not acknowledge the claim or enter into a defence, I should just let my insurers deal with it.
I will make sure to phone them every couple of days to keep a check and chase them.
I scanned and emailed court papers to them and they have responded saying that they are "in receipt of my email" have "appointed X as Legal recovery solicitors hence we have asked them to deal with the third parties counter claim."
I would disagree with with MSE.
If you have received a claim you should not ignore it.
If you ignore it and your insurers cock up and miss the deadlines you could end up with a CCJ by default.
The claim is against you personally and it is your responsibility to ensure it is dealt with.
Accordingly I would acknowledge (but not enter a defence) and pass it to my insurers..
This gives your insurers a longer time to deal with the matter
If it had been just a letter before claim and not court papers I would agree with MSE
As your insurers have acknowledged the claim, just keep an eye on it to make sure they deal with it expeditiously
As above #4 if you want to possible lose before you start then listen to MSE,., situation present is delay delay even a 7 day switch took a month so be ware
