  • Voluntary Termination Extra Charges (missing service)

    Hi there,

My partner is in the process of VTing his vehicle as it is no longer suitable and I have been reading up on the process. There is a wealth of knowledge on here but I feel like I've now read myself into confusion so thought it would be easier to create my own thread. R0b I'd be so grateful for any advice if you have any please!

I've prepared my partner for the worst and am I expecting charges to come from the company. One thing they note is that if there is no proof of regular servicing in line with the manufacturers recommendation it will be a £300 cost. Frustratingly, my partner thought that services could be conducted bi-annually and so there is one missing. No where in the contract does it state that proof of regular servicing is a must and the car is 6 years old having had a service every year apart from one - does that constitute reasonable condition?

They also want the spare key returned, which is lost (I'm thinking that might just have to be paid for) but I wanted to query if it is a legal obligation to pay for these extras they list as I've read multiple times that the person is only liable for 50% of the total amount payable?

Grateful for any advice RE the missing service/key/extra costs I'm expecting them to send through as the car is being collected soon.

    Thanks!

Think you’ve already answered your own question. How can they enforce something that isn’t in the contract? Annual service is usually sufficient but let them raise it and toss it back to them. Obviously that does depend on the circumstances so you need to take a view on that.

Can they prove there was a spare key when you got the car? If not, bat it back to them and tell them to prove it, unless you are willing to pay for it. If it can be proved, you would be responsible for cost of replacement.
If you have a question about the voluntary termination process, please read this guide first, as it should have all the answers you need. Please do not hijack another person's thread as I will not respond to you
