  • Help! Rights of access over my garden- mid terraced house

    Hi there, so but of background.. I live in the 3 terraced house out of a row of 5, i have an entry to the left of my house, my neighbour to the right has access over my garden. I have two big dogs and I need to make my garden more secure for them. I will also be putting a new taller gate in for security and the neighbour will not loose any access, it will just mean they will have another gate to go through.. they use the back access as there main access (extremely annoying as it’s constant in and out past my kitchen window and it obviously sets my dogs off as they think someone is coming to the house) my neighbour is now complaining about having to go through another gate and because I am putting a fence in place to secure the garden, even though she is not loosing any rights of access.. she has lived in the house a lot of years so I do feel she thinks she is entitled to have a say in what i do with my land. (Im not the only neighbour she is having disagreements with) Am I within my rights to secure my garden and the access through because of the dogs? As I’ve stated no rights of access will be taken away from my neighbour she will just have an extra gate to go through and I am doing everything within my boundaries. Thanks

    Provided you are not hindering her access I can't see what she has to complain about (maybe she's one of these people who likes to complain for complainings sake). I am currently having an issue from your neighbours point of view, but the gate erected in front of my access is locked and bolted, plus a further concrete wall instead of a second gate, so I think I have a right to complain. I'd be more than happy if my neighbour was just adding a simple gate like what you're proposing.

    A fence around your garden should be none of her business, but I would suggest some form of automatic gate closer - don't rely on her to close it.
