    Hi all, was hoping for some advice. I’ve was arrested by the police more than 6 months ago now and originally bailed for 3 months from that date pending investigation. Every month since bail, it gets extended 5 times in total, it’s mental torture especially when the offence is very minor and was greatly exaggerated.

    can the Police continually extend the bail? Am I right on saying after 3 months or needs to be approved by the magistrates court? This hasn’t been done,

    Sec 63 of the Policing and Crime Act 2017 (https://www.legislation.gov.uk/ukpga...ion/63/enacted) confirms your understanding that, initially, the police can only bail a person for 28 days, although this can be extended by a senior police officer to a total of three months, and thereafter it can be further extended by a magistrates' court, ultimately indefinitely..

      Thanks Des8, it’s the police service off NI, with it being the UK, same legislation would apply. So really at this stage they will have to make an application to the magistrates.

      they are holding my possessions as well, an IPhone, an Apple Watch and Laptop, should they not give them back at this stage?

        Sec 52 to 67 of the act only apply to England & Wales.

        I suggest you have a short interview with a solicitor, or try a local Citizens Advice Bureau to ascertain the law in NI
