  • POPLA appeal

    Hi,
    can anyone advise me please. I parked and paid via an app. I made an error inputting the location code by 1 digit.
    I recieved a fine which I appealed to POPLA on the basis of a keying error.
    POPLA rejected it stating that only vehicle registration was covered in keying errors.
    Is this correct?
    Are there any other options open to me?
    what happens if I don't pay?

    That's what their Code Of Practise says. Not sensible as you have paid for parking. You could try appealing to POPLA along the same lines but I doubt they would accept.

    if it did go to court then a judge would probably agree with you, that the error was de minimus and you completed your contract with a minor error and the claimant lost nothing

      How do I take this to court?
      Do I refuse to pay and wait for it to escalate or will that just end in debt collection?
      I'm tempted to go to court if the risk to me is not too great.
      could I end up with costs to pay on top of the fine?

        You can't take it to court, you have to wait for them. Who is the parking company?

        You ignore debt collectors but not a "letter of claim" if it is received

        PE claim £170, others try for more, about £200. Anything more can be argued against.

              Sounds like it might be best to pay. Even though its clearly unfair and immoral. Legalised theft.
