  • Complain Private Conduct

Hi. I privately rent and my upstairs leaseholder neighbour is a conveyancing solicitor whose private behaviour is very inconsiderate. They have interferred with mail, arranged for a window cleaner to enter my property without my permission which required trying to open a padlocked gate from the inside, placed occupiers at fire risk by using communal meter cupboard with private old clothing storage, taken the spare front door key and loaned to estate agents for viewing their property which if would stop escape in emergency, fly tipped in to a neighbours overgrown garden. These are just the main conduct points. They tattle tailed to my landlord about my gate banging when it was only a case of being caught by wind. I was wondering if this private behaviour has any bearing on their professional code of conduct and if so who I could complain to. Any advise please. Thank you

    Hi Legal QS

I don't think it breaks professional standards, although it might breaks social norms (expected behaviour). Here's some info:

Thanks but I don't think their fly tipping would acceptable to their employer, I have read it can be considered disreputable to their profession. Interfering with neighbours mail is a criminal offence.

O.K. some questions for you, regards to the 'fly tipping', have you reported that to the council who can consider his conduct and potential penalties?
Again 'interfering' with mail, you haven't expanded on what they have done regards your mail, i.e. have they delayed in returning it to you?
Have you reported the 'interference' to the police / Royal Mail, if not why not? Why is your emphasis on his professional code of conduct?

I work for the local council and spoke with a colleague, the fly tipping was on next door private garden, very overgrown and owing to large size and possibly future building plans separate from the main property. I placed a fly tipping leaflet on the wall where it could be seen and a few days later the item (large) was removed. It wasn't my mail but the person whose mail went missing did report to the police, the solicitor put a notice on the main door saying if any mail wasn't collected they were taking it upon themself to forward to our respective landlords, two different landlords. Why not just put it through our individual letter box I asked myself would be simplest. Where is the plan to retrieve our forwarded mail and did they think to check with our landlords if this was OK, no of course not. I wrote a note on the original saying that as the matter had been reported to the police that no one should be interferring with other peoples mail, they removed the note.
I'm a 60 plus being pushed around by a half my age jumped up inconsiderate person who should know better considering their profession. There are more things obviously.
